This Privacy Policy describes how Fluxently AI LLC ("Company," "we," "us," or "our") collects, uses, and shares information when you interact with our websites, funnels, forms, services, and communications (including SMS/text messaging, telephone calls, and AI-powered conversational agents). By using our services, you agree to this Privacy Policy.

2) INFORMATION WE COLLECT
We may collect:
Contact Information: name, email address, phone number, business name, address.
Lead/Service Details: information you submit via forms, surveys, chats, calendar bookings, or applications, and information you provide during a telephone call or text message conversation with us.
Communication Data: records of emails, calls, and text messages between you and us, including message content, timestamps, call recordings, and call transcripts. See Section 5 for how call recording works and how you can decline it.
Device/Usage Data: IP address, browser/device type, pages viewed, referring URLs, approximate location (city/state), and usage events collected through cookies, pixels, SDKs, and similar technologies.
Payment Data (if applicable): billing details processed by our payment providers. We generally do not store full card numbers.
We do not collect biometric identifiers or biometric information as those terms are defined under the Illinois Biometric Information Privacy Act. Our call recordings are stored and transcribed for quality and record-keeping purposes only. We do not create, capture, or use voiceprints, and we do not use voice recordings to identify or authenticate individuals.
3) HOW WE USE YOUR INFORMATION
We use information to:
Provide, operate, and improve our services and websites/funnels.
Respond to inquiries and deliver requested resources.
Schedule appointments and provide customer support.
Send service-related messages, including reminders, confirmations, and updates.
Send marketing communications if you opt in, including SMS, email, or telephone calls.
Demonstrate our own products to prospective customers. See Section 4 for what this means if you request a live demonstration.
Measure advertising performance and attribute conversions, for example when you submit a form or book a call after seeing an ad.
Create remarketing audiences and exclude audiences, for example to avoid showing ads to people who already booked.
Prevent fraud and abuse, and maintain security.
Comply with legal obligations and enforce our agreements.
4) AUTOMATED AND AI-POWERED COMMUNICATIONS
Some or all of our outreach is delivered by artificial intelligence. This section explains what that means.
AI agents. When you provide your contact information to us, you may receive telephone calls and text messages handled by an AI conversational agent rather than a human being. These agents can hold a natural conversation, answer questions about our services, ask qualifying questions, and schedule appointments.
Disclosure. We identify our AI agents as artificial intelligence. Our text message conversations disclose AI involvement at the start of the conversation, and our AI voice agents disclose that they are AI. If you ask at any point in a conversation whether you are speaking with a person or with AI, we will tell you truthfully. We will never claim to be human.
Reaching a human. You can request a human at any time during any conversation, by voice or by text, and we will route you to one. You may also contact us directly using the details in Section 16.
Automated dialing and prerecorded or artificial voice. Where you have given the required consent, calls and text messages we send may be placed using automated technology, including automatic telephone dialing systems and artificial or prerecorded voice. Consent to receive these communications is not a condition of purchase.
Live demonstrations. If you opt in to a live demonstration of our system, you are enrolled as a live test lead. This means you will personally receive the full sequence our software delivers on behalf of our clients, which includes an AI voice call placed shortly after you opt in, follow-up text messages over the following days, and optionally an appointment booking flow. This is the demonstration. You can end it at any time by replying STOP to any text message, by telling any of our agents to stop contacting you, or by contacting us using the details in Section 16.
5) CALL RECORDING AND TRANSCRIPTS
We record and transcribe inbound and outbound telephone calls for quality assurance, training, dispute resolution, and record-keeping.
Illinois and other two-party consent states require the consent of all parties to record a conversation. Our agents therefore state at the beginning of each call that the call is being recorded. If you do not consent to being recorded, tell the agent and we will either end the call without recording it or continue without recording, at your option. Continuing the call after the recording notice constitutes your consent to be recorded.
Call recordings and transcripts are treated as Communication Data under Section 2 and are subject to the retention rules in Section 10.
6) SMS/TEXT MESSAGE PRIVACY AND CONSENT (A2P/10DLC)
If you provide your phone number and opt in to receive SMS/text messages from us:
We may send messages about your inquiry, appointments, service updates, and, if separately opted in, marketing.
Message frequency varies.
Message and data rates may apply.
Consent to receive texts is not a condition of purchase.
We do not send marketing text messages before 8:00 a.m. or after 9:00 p.m. in your local time, and our practice is to avoid sending outside normal business hours in your time zone wherever we can determine it.
We do not sell your personal information, including your phone number, to third parties for their own marketing. We do not share mobile information or SMS consent with third parties or affiliates for their own marketing purposes.
7) HOW TO STOP HEARING FROM US
You may withdraw your consent to be contacted at any time, by any reasonable method, and you do not need to use any particular word or phrase.
Text messages. Reply STOP, QUIT, END, CANCEL, REVOKE, OPT OUT, or UNSUBSCRIBE to any message. Any other reply that a reasonable person would understand as a request to stop, such as "please stop texting me" or "take me off your list," is equally effective and will be honored.
Telephone calls. Tell any agent, human or AI, that you do not want to be contacted again. You do not have to explain why.
Any channel. Email us at [email protected] or call 224-723-8506 and ask to be removed.
When you withdraw consent through any channel, we apply that withdrawal across all channels. A request made by text message stops our calls and emails as well, and a request made by phone stops our text messages as well. We honor withdrawal requests as soon as practicable and in no case later than ten business days from receipt.
After you opt out, you will receive at most one message confirming that you have been unsubscribed. That message will contain no marketing content. We will not attempt to talk you out of your decision, and we will not send you a retention offer.
We retain a record of your opt-out indefinitely. This is necessary to ensure we do not contact you again, and it is the only purpose for which that record is used.
8) HOW WE SHARE INFORMATION
We may share information with:
Service Providers and Vendors (Processors): companies that help us run our business, including CRM, email and SMS delivery, telephony and voice AI, scheduling, data storage, workflow automation, analytics, website and funnel hosting, call tracking, large language model providers, and payment processing. They may access information only as needed to provide services to us and are contractually required to protect it.
Advertising and Analytics Partners: we may share limited information with partners such as Meta (Facebook/Instagram), Google, and similar platforms to measure ad performance, attribute conversions, and deliver ads to people who may be interested.
Legal and Compliance: if required by law, court order, or to protect rights, safety, and security.
Business Transfers: if we are involved in a merger, acquisition, financing, or asset sale, information may be transferred as part of that transaction. Any successor will be bound by the commitments in Sections 6 and 7 regarding your phone number and your withdrawal of consent.
9) COOKIES, PIXELS, AND TRACKING TECHNOLOGIES
We use cookies and similar technologies, including pixels, to operate our pages, understand performance, prevent fraud, and support marketing.
Meta Pixel and Advanced Matching. We may use the Meta Pixel and related features, including Advanced Matching, to help Meta match website visitors to Meta users. Where available, identifiers such as email address or phone number that you provide to us may be shared in a hashed format to improve attribution, analytics, and remarketing. This helps us understand which ads lead to actions like form submissions and booked appointments.
Conversions API and Server-Side Tracking. We may also send certain events to advertising platforms directly from our servers to improve reliability of measurement and attribution.
Your choices. You can adjust your browser settings to refuse cookies or delete them. Some features may not function properly without cookies. Where required by law, we will provide a cookie consent mechanism.
10) DATA RETENTION
We retain personal information only as long as necessary for the purposes described in this policy, including maintaining records for business operations, legal compliance, dispute resolution, and enforcing agreements.
Call recordings and transcripts are retained for as long as needed for quality assurance and record-keeping, and are deleted or anonymized when that purpose has been served.
Records of consent and records of withdrawal of consent are retained indefinitely, because we are required to be able to demonstrate that consent existed and that opt-outs were honored.
11) DATA SECURITY
We implement reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is 100% secure.
12) YOUR CHOICES AND RIGHTS
Depending on your location, you may have rights to:
Access, correct, or delete your personal information.
Withdraw consent for marketing communications at any time. See Section 7.
Request a human rather than an AI agent in any conversation. See Section 4.
Decline to be recorded on a telephone call. See Section 5.
Opt out of certain advertising uses.
Opt out of targeted advertising. You can adjust ad preferences on platforms like Facebook and Instagram and in your browser or device settings. You may also use industry opt-out tools such as those provided by the Network Advertising Initiative (NAI) or the Digital Advertising Alliance (DAA).
To exercise any of these rights, contact us using the details in Section 16. We will not discriminate against you for exercising them.
13) U.S. STATE PRIVACY DISCLOSURES
Some state laws require additional disclosures.
Do we sell or share personal information? We do not sell personal information. We may share personal information for targeted advertising or cross-context behavioral advertising, as those terms are defined under certain state laws, through tools like pixels and advertising partners. We never share phone numbers or SMS consent for third-party marketing.
Categories of personal information disclosed may include identifiers (name, email, phone), internet and activity data (cookie IDs, page views), and commercial information (service interactions).
Right to opt out. If applicable in your state, you may have the right to opt out of targeted advertising or sharing. To request this, contact us using the information in Section 16.
14) ILLINOIS DISCLOSURES
Fluxently AI LLC is located in Illinois, and the following applies to Illinois residents and to communications originating from or received in Illinois.
Artificial intelligence disclosure. Consistent with Illinois law, we disclose that our conversational systems are artificial intelligence, and we will confirm that fact whenever asked. See Section 4.
Recording consent. Illinois requires the consent of all parties to record a private conversation. Our recording notice and your ability to decline are described in Section 5.
Biometric information. We do not collect, capture, purchase, receive through trade, or otherwise obtain biometric identifiers or biometric information as those terms are defined by the Illinois Biometric Information Privacy Act, 740 ILCS 14. We do not generate voiceprints from call recordings.
15) CHILDREN'S PRIVACY
Our services are not intended for children under 13, or the age required by local law. We do not knowingly collect information from children. If we learn that we have collected information from a child, we will delete it.
